Objective :- To provide for the Maintenance & Welfare of Parents & Senior Citizens. Maintenance not only includes financial assistance but it also includes provisions for food, clothing, residence, medical attendance & treatment. This Act makes it compulsory & mandatory for all children or relatives (incase of childless senior citizen) to maintain a senior citizen.

Key Features :-

i. If any Senior Citizen[1] including Parent[2], cannot maintain himself from his own earning or property owned by him, he may file an application under this Act, for claiming maintenance from his children or against his nearest relative.

ii. Citizens of India residing outside India can also claim maintenance.

iii. Relatives of a Senior Citizen having sufficient means, and who is in possession of the property of such

senior citizen or if he is likely to inherit such property of the senior citizen in the future, is liable to maintain the Senior Citizen.

iv. Application for maintenance may be filed by the Senior citizen or Parent himself or if he is incapable by any other person or organization authorised by such him.

v. Application for maintenance may be filed before the “PARENTS & SENIOR CITIZENS WELFARE & MAINTAINENCE TRIBUNAL” either in the District (a) where such Senior Citizen or Parent resides or (b) where the Children or relatives reside.

vi. Where children or relatives fail to maintain the Parent or Senior Citizen and do not pay the monthly allowance/ maintenance amount as may be awarded by the Tribunal, then it may result in imprisonment for one month or until payment is made.

vii. Appeal can be filed only by the Senior Citizen or Parent who is aggrieved by the order of the Tribunal within 60 days from the date of the order.

viii. It is not necessary to hire a lawyer or advocate. Senior Citizen or the Parent is entitled to file & argue the case himself before the Tribunal & in Appeal.

ix. If the Senior Citizen has transferred his property through gift or otherwise, to his children or to any other person on the conditions, that such children or other transferee shall provide the basic amenities & support the Senior Citizen, and if such children or transferee fail to provide the same, then the Transfer of Property shall be deemed to have be made by undue influence, fraud and at the request of the Senior Citizen may be declared Void by the Tribunal.

[1]Senior Citizen” means any person above the age of 60 years.

[2] “Parent” means father or mother whether biological, adoptive or step father or step mother ; it is not necessary that parent should be a Senior Citizen.
